July 25, 2011
The Council for the City of Wilton, Iowa met in regular session in the Council Chambers at City Hall on Monday July 25, 2011. Mayor Bowman called the meeting to order at 7:00 PM. The Mayor then led the group in the Pledge of Allegiance.
Council Members present at this meeting: Richard Garrison (present at 7:10), Robert Barrett, Matt Fowler, and Keith Stanley. Absent: Steve Owens. Also present at this meeting City Administrator Joel Laws, Advocate News Correspondent Connie Brown, Muscatine Journal News Correspondent Charles Potter, Carla Thurston, Sharon Bowers. Norman Grunder, Jackie Barten, Julie Froehlich, Jim & Joan Voss, Jake Hoekstra, Greg Shuger, and Ruth Ann Wilson.
The agenda was presented for this meeting. It was moved by Member Fowler seconded by Member Stanley that the agenda be approved. The roll was called and the vote recorded as follows:

Minutes for the regular meeting held July 11, 2011. A motion was made by Member Barrett seconded by Member Fowler that these minutes be approved. The roll was called and the vote recorded as follows:

CITIZEN APPEARANCE:
Ruth Ann Wilson, owner of One More Round of 1211 W 5th, appeared before the Council to inform them of some upcoming events. She said that they are not planning anything special for RAGBRAI other than having a food vendor outside of their building. Ruth Ann added that they are planning on having an outside band on Saturday August 13th. This will be the 2nd annual Head Bangers Ball, the first annual event was held at their bar inMuscatine. The ball will open at 2:00PM and they have a multiple bands scheduled to play outside until midnight and then they will move inside. She has some local food vendors that will be serving outside on that day. (Member Garrison was present at this time) The bar has additional dram shop insurance for that day and will be applying for an outdoor liquor license. Mayor Bowman explained to Ruth Ann that if they have noise complaints, they will be asked to turn down the volume. She replied that they will be trying to face the speakers away from the residential area. Council approved her request for the outdoor service, pending the proper paperwork be filed with the State. They thanked Ruth Ann for the information.
Wilton Development Director Jackie Barten presented to the Council applications for the revitalization project. The first was from Allen Consulting Group 123 W 4th. He is putting on a new store front and windows. Total for this project is $4610 and City cost of one half would be $2305, this was approved by the WDC committee. The next was from Valet’s Service station in the amount of $3668. The committee reviewed this application and even though the rules state that the application should be filed before the work is done, the members felt it was a good investment and it was approved. One half of the cost for Valet’s is $1834. Discussion was held and it was then moved by Member Barrett seconded by Member Fowler that these two applications be approved in the amount of $4139. Jackie then reported to the Council that the revitalization committee received an application from Brian Froehlich of Fro’s. His grind & tuck pointing had already been approved by the Committee and by the Council in April in the amount of $3750. He is now painting and putting in windows at the top of the building and wanted to add this to the application. This would make the total for Fro’s $4960. Discussion was held on this request and Council felt the whole project was a great improvement. It was then moved by Member Fowler seconded by Member Garrison that the amendment to the previous request be approved. The roll was called and the vote recorded as follows:

Since the Council is looking at new guide lines for the revitalization program, Jackie asked it they would be interested in looking at the application that was denied by the WDC. This application was made by Tom Youngwirth for tuck pointing, grinding and painting of his apartment building on W 4th Street. Council said they would reconsider the application but asked Jackie to take it back to the WDC committee for their review.
Julie Froehlich representing Fro’s asked if they could borrow 20 fence posts and some garbage cans for their outdoor service this Saturday for RAGBRAI. The City Administrator will meet with them to help them out with this request for this weekend.
LEGAL ITEMS:
A proposed Ordinance entitled “An Ordinance Amending Title 10 of the Wilton Municipal Code Entitled “Vehicles & Traffic” Regarding Certain Stop Signs in the City of Wilton, Iowa” was presented to the City Council for discussion. This will be to place a permanent stop sign atE Summitand East Streets. The Council is hoping that this will slow traffic down onE Summit Street. After consideration it was moved by Member Stanley seconded by Member Barrett that said Ordinance be passed on first consideration. The question being upon the foregoing motion, the roll was called and the vote recorded as follows:

Nays: None Motion Carried.
It was then moved by Member Barrett seconded by Member Fowler that the requirement that said Ordinance be considered and voted on for passage at two Council meetings prior to the meeting at which time it is finally passed be suspended and that said Ordinance be fully adopted. Upon the question of suspending said requirement the roll was called and the vote be recorded as follows:

A proposed Ordinance entitled “An Ordinance Amending the Code of Ordinances of the City of Wilton, Iowa by Updating Title 14 Under Section 14.16 Entitled “Water Rates” was presented to the City Council for discussion. After consideration it was moved by Member Stanley seconded by Member Garrison that said Ordinance be passed on the third consideration. The question being upon the foregoing motion, the roll was called and the vote recorded as follows:

MAYOR ITEMS:
At this time Mayor Bowman announced that he would like to appoint Tony Hurd to fill the position on the Library Board. This 6 year term will expire 7-1-17. It was moved by Member Garrison seconded by Member Stanley that this appointment be approved. The roll was called and the vote recorded as follows:

Mayor Bowman reported that he has spoken with Park Board President Mark Maurer about getting a concession/rest room/storage building constructed atWestViewPark. He explained to Mark that the budget for the City is pretty tight this year and maybe donations could be collected for this building project. Mark did have two bids for the building of the new concession facilities. It was noted that they would prefer a block building with steel doors. Mark Peterson of WTC has said that they would be willing to install security cameras on the new building to help deter vandalism. Since there was a building in the park previously, there is already water and sewer lines in place for the hookups. The Mayor then met with WDC and they felt this was a worthwhile project for the City and they have committed $5000 for the start of the project. Dennis Hanser representing Wilton Precision Steel also talked with the Mayor stating his interest in donating to this project. Dennis said that Wilton Precision Steel will donate the rebar for this project and will also make a cash donation (no specific dollar amount was given at this time). Members were appreciative to hear that these organizations were willing to contribute to this project and thought it would really enhance that park. The City Administrator said this would be a great addition to West View especially since we will be adding healthy activity stations along the walking path. Joel will inform the Park Board and meet with them to make plans to proceed and bring recommendations back to the Council.
When doing the clean up this weekend Mayor Bowman noticed that the roof on the building behind City Hall is in need of repair. He and Member Stanley were inside the shed and noticed that there are leaks in the roof in several places. The City should proceed to get prices on getting this roof replaced. Members thought it would be a good idea to get a roof that would match the Depot andElderParkshelter. The City Administrator will check on this repair. Mayor Bowman wanted to thank everyone that helped this past weekend for the clean up day for RAGBRAI. The volunteers walked the route, flowers were planted, weeds were pulled and trash was picked up.
Mayor Bowman gave the Members copies of letters that he has prepared. The first one is to Kit Koele & Julie Smith for their work on the offset program. This offset program is for cities to collect bad debt from previous customers. Kit & Julie have attended meetings and have done a lot of research to help collect these past due debts. To date around $6000 has been collected for the old water and electric bills. The other letter was to Muscatine Mayor Dick O’Brien sending best wishes to him from the City ofWiltonon his retirement.
CORRESPONDENCE:
A note was received Ann Sindt Goebal regarding the sign for the walnut trees on the highway. She wanted to thank the City for their support on this project and she will be getting the details to City Hall so the sign can be ordered.
COUNCIL ITEMS:
A sidewalk reimbursement was presented for 401 W 6th Street by John Brandies. The City Administrator said he has checked this sidewalk. The City Administrator reported to the Council that there was only $2000 budgeted for sidewalk reimbursements this year. With this request, $1500 has already been spent out of that amount and three more applications were given out this week. Discussion was held and the Council feels that this is a good program for the City and the citizens have been taking advantage of the reimbursement. They would like to see it continue and not decline because of lack of funds. The Council asked the City Administrator to check the budget to see if $3000 more could be extended to the sidewalk program for this year. They will make sure and adjust this line item when doing next year’s budget. It was then moved by Member Barrett seconded by Member Fowler that the presented reimbursement be approved. The Wilton Chamber of Commerce Beer permit application for Founder’s Day was submitted. All paperwork has been filed on line, subject to the dram shop being sent. It was moved by Member Stanley seconded by Member Garrison that this permit be approved as soon as the dram shop is received by the State. The roll was called and the vote recorded as follows:

The Cedar County Solid Waste Assessment was presented for payment. Last year this assessment was $10,295.00 and this year it is $10,017.88. Council was happy to see that there was a decline in the amount due. It was moved by Member Barrett seconded by Member Fowler that this assessment be approved for payment. The roll was called and the vote recorded as follows:

A request was sent by the Wilton Athletic Boosters regarding their annual membership drive. A commitment of $250 is what they are asking from the local businesses. It was moved by Member Fowler seconded by Member Garrison that $250 be approved for the Athletic Booster membership. The roll was called and the vote recorded as follows:

A revised Wilton Commercial Revitalization document was presented to the Council for approval. There were some minor changes made to the rules and regulations for eligibility. The overall goal of this program is to help owners enhance the appearance of their buildings and attract customers and tenants. After review of the changes, it was moved by Member Stanley seconded by Member Garrison that the new rules be approved. The roll was called and the vote recorded as follows:

The City Administrator presented two proposed secondary meter ordinance. This would be for residents to install and use to meter water for pools, sprinklers and other outside activities. Option one states that the owner would buy the meter, have it installed and pay for any additional plumbing. The owner would then only be charged actual gallons used and no sewer. Option two would be that the City absorb the cost of the meters and charge a yearly service fee of $35 for maintaining and installing costs. The homeowner would be required to do all of the plumbing work at their expense. The owner would also be charged a minimum water charge at the current rates with no sewer charges. There may also be additional fees to consider such as: inspection fees for the meters, re-connection fees and minimum usage fees. Discussion was held and there were mixed views on these proposed ordinances. Council asked Joel to do more checking with area cities to see if there are other options.
A letter of agreement was received from the Cedar County Auditor’s office regarding cities and counties having the power to combine township and city precincts. The letter states that the Wilton City Council and Cedar County Board of Supervisors agree to create a combined voting precinct regarding Farmington/Sugar Creek townships. This deals with the few residents that the City ofWiltonhas living inCedarCounty. After a review of the agreement, it was moved by Member Barrett seconded by Member Stanley that it be approved for the Mayor to sign the letter. The roll was called and the vote recorded as follows:

Fro’s had submitted an application for outdoor service for Saturday July 30th which is RAGBRAI. All paperwork is in order for the online application. It was moved by Member Stanley seconded by Member Fowler that this application be approved. The roll was called and the vote recorded as follows:

The contract for the water/wastewater superintendent was given to the Council for approval. Robert Kreimeyer has signed the contract to accept the offer to become the superintendent. The contract states stipulations that within one year he must obtain his grades for Water & Wastewater.
MemberStanleyappreciated the help of the volunteers that worked last Saturday to help get the town ready for RAGBRAI. Every little bit that was done helped make the City more presentable.
Member Garrison wanted to give a Gold Star to Rhoda Grunder who lives north ofWilton. Even though she does not live within the city limits, she has been an upstanding member of the community. Each time he passes her house he appreciates the work that she does to make her flowers look great.
Mayor and Council sent out condolences to the family of the pilot of the helicopter that crashed nearWiltontoday.
ADMINISTRATIVE ITEMS:
There is a new request for some concrete to be poured at the City maintenance shop onJackson Street. This spot is on the north side of the building and in front of each stall where the vehicles park. There is no concrete there at this time and after the vehicles are washed, they get dirty and also take the dirt into the shop area. There is money in the budget to pay for this work. Joel got two bids on this 75 X 20 foot area. Bids are as follows: Eller Construction $5700.00 and Hoekstra Masonry $5655.00. After checking the bids, it was moved by Member Fowler seconded by Member Stanley that the bid from Hoekstra Masonry be accepted. The roll was called and the vote recorded as follows:

The bleachers are Cherrydale were repaired with new boards and painted. Joel attended a safety meeting for setting up a training schedule for employees. He also posted an ad for the public works/water department position. These applications are due August 3rd. The public works department has also been mowing, weeding, painting and patching to help get ready for RAGBRAI. This Friday will be dedicated to getting everything ready for the event this Saturday.
BILLS:
The Financial Statements were accepted and placed on filed. It was moved by Member Stanley seconded by Member Fowler that the total disbursements of $219,158.17, approved by the Finance Committee, be allowed and instruct the City Clerk to pay the same. The roll was called and the vote recorded as follows:

ORDINANCE NO. 486
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF WILTON, IOWA BY UPDATING TITLE 15 UNDER SECTION 15.28, ENTITLED "TREATMENT PLANT CHARGES AND RENTALS "
Be it enacted by the City Council of Wilton, Iowa:
SECTION 1: This ordinance as amended is enacted is to add changes of rates in the portion of Title 15 of the Wilton Municipal Code pertaining thereto.
Title 15, Section 15.28
Treatment Plant Charges and Rentals

15.28.010 Schedule of Rates
15.28.020 Special rates - - Conditions requiring adoption.
15.28.030 Special rates - - Sewage from private water supply.
15.28.040 Payment.
15.28.050 Unmetered dwelling units.
15.28.010 Schedule of rates. The rates for the use of and for service rendered by the Wilton sewage treatment plant shall be paid by the owner of each and every lot or parcel of real estate or building that is connected with and uses the sewage treatment plant, as follows:
(a) For the period of July 1, 2011 through June 30, 2012 (Fiscal Year 2012).
(1) All customers will be charged a customer charge of thirteen dollars and five cents per month which includes the first two thousand gallons per month. This is also the minimum bill per month;
(2) Fourteen dollars and five cents user fee for the use of two thousand one to four thousand gallons per month plus two dollars and forty seven cents per one thousand gallons used in excess of two thousand gallons.
(3) Fourteen dollars and five cents user fee for the use of four thousand one to nine thousand gallons per month plus two dollars and forty seven cents per one thousand gallons used in excess of two thousand gallons.
(4) Fifteen dollars and no cents user fee for the use of over nine thousand gallons per month plus two dollars and forty seven per one thousand gallons used in excess of two thousand gallons.
(b) Pretreatment Contributors. (Each contributor who operates a pretreatment plant may connect to the city sewer system subject to the approval of the city engineer and city council.) Twenty one dollars and sixty nine cents user fee plus three dollars and twenty one cents per one thousand gallons used in excess of two thousand gallons.
15.28.020 Special Rates – Conditions requiring adoption. Where, in the judgment of the city council, special circumstances surround the use of any water to such an extent that the charges and rentals hereinbefore set forth would inequitable or unfair either to the city or to the contributor, special rates may be established by resolution of the town council, and such special rates may be adopted in the following situations:
(1) Where the use of the water is such that, in the opinion of the superintendent, the resulting sewage has characteristics making it more or less difficult to treat or purify than ordinary sewage;
(2) Where are major proportion of the water consumed is not polluted and is not discharged either directly or indirectly into and does not reach the sewage treatment plant.
15.28.030 Special rates – Sewage from private water. Special charges and rentals shall be made in all cases where sewage originating through the use of a private water supply are discharged directly or indirectly into the sanitary sewer system. Such charges and rentals shall be on an equal basis with those applicable to an equal quantity and character of sewage originating through the use of water sold by the city and shall be established by resolution of the city council. It shall be the duty of every person, firm, or corporation responsible for the production of such private water supply to report forthwith to the superintendent and to cooperate with the superintendent in the determination of the quantity and character of the sewage originating through the use of such private water supply. The superintendent shall designate the method of measurement of such private water supply and the sewage flow resulting therefrom and the meters or other instruments used for such measurement shall be installed by and at the expense of the contributor upon written order of the superintendent.
15.28.040 Payment. The charges and rentals herein provided for shall be computed upon each contributor’s wastewater bill due and payable on and after July 1, 2011 and these charges and rentals shall thereafter be paid and collected as herein provided.
15.28.050 Unmetered dwelling units.
(a) When a dwelling house, multiple-dwelling unit, building, trailer court or other like structure or premises is occupied, or constructed to be occupied, by more than one consumer and is not now separately metered, each individual subunit, apartment or separate consumer in such structure or premises shall be treated as a contributor for the purpose of the rates defined in Section 15.28.010. The appropriate user fee, as defined in 15.28.010, shall be paid for each subunit, apartment, or consumer occupying any such dwelling house, multiple-dwelling unit, building, trailer court or other like structure or premises and the monthly billing to each such consumer shall be based upon the number of gallons so determined and computed for the appropriate rate category as set forth in Section 15.28.010.
(b) Both the consumer and the owner of the real estate on which is located the structure or premises shall be jointly and severally responsible for payment of all billings. If an owner does not pay any delinquent bill by the twenty-fifth day of the month following the default, the city may discontinue water and sewer service to the entire structure or premises. If the service is discontinued in such circumstances, all prior bills and delinquencies must be paid and all future water service must be separately metered and billed to each consumer before service is restored. Any dwelling house, multiple-dwelling unit, building, trailer court or other like structure or premises which is hereafter constructed or converted and is occupied by more than one owner, tenant or consumer, shall be so constructed that water service is separately metered and billed to each such consumer.
SECTION 2: REPEALER. All ordinances or parts thereof in conflict with the provisions of this ordinance are hereby repealed.
SECTION 3: SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional such adjudication shall not affect the validity of this ordinance as a whole or any section, provision, or party thereof not adjudged invalid or unconstitutional.
SECTION 4: WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval, and publication as provided by law.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF WILTON, IOWA BY UPDATING TITLE 14 UNDER SECTION 14.16, ENTITLED "WATER RATES "
Be it enacted by the City Council of Wilton, Iowa:
SECTION 1: This ordinance as amended is enacted is to add changes of rates in the portion of Title 14 of the Wilton Municipal Code pertaining thereto.

14.16.010 Schedule of rates. The rates and charges for water supplied through the municipal waterworks system shall be as follows:
(a) For the period of July 1, 2011 through June 30, 2012 (Fiscal Year 2012).
(1) All customers will be charged a customer charge of eight dollars and sixty five cents per month which includes the first one thousand gallons of water. This is also the minimum bill per month;
(2) For the next eight thousand gallons per month the sum of two dollars and seventy cents per one thousand gallons;
(3) For all over nine thousand gallons per month the sum of two dollars and sixty five cents per one thousand gallons.
14.16.011 Fuel and energy cost adjustment. The foregoing rates for each gallon of water shall be increased by dividing the total gallons of water sold each month into the fuel and energy purchased by the combined water and wastewater departments. The resulting number will be the “fuel factor.” The total gallons consumed monthly by a customer shall be multiplied factor to generate the fuel and energy cost adjustment. Adjustments for the cost of fuel and energy purchased shall be charged monthly and shall be based on the average cost of fuel and energy purchased during the preceding month. The monthly “fuel factor” shall be transferred each month from the water fund to the general fund.
14.16.020 Due date - - Penalty for delinquency. All water bills payable under the rates set forth in Section 14.16.010 shall be due and payable monthly and on the first day of each month following and shall be delinquent on the twentieth day of that month. In the event of failure to pay any such bill prior to its becoming delinquent, an additional charge of five percent per month shall be added to the bill and the entire bill, including such additional charge shall be immediately due and payable. The city may discontinue service to any consumer whose bill remains unpaid on the twenty-fifth day of the month.
14.16.030 Existing dwelling units. Where an existing dwelling house, multiple-dwelling unit, building, trailer court or other like structure or premises is now occupied by more than one consumer and is not now separately metered, the total gallons of water used shall be divided by the number of consumers and monthly billing to each consumer shall be based upon the number of gallons so determined computed at the rates set forth in this chapter.
If any such consumers shall default in the payment of his/her portion of the monthly billing, the owner of the structure or premises shall become responsible for payment of all delinquent billings. If the owner does not pay the delinquent bill by the twenty-fifth day of the month following the default, the city may discontinue water service to the entire structure or premises. If service is discontinued in such circumstances, all prior bills and delinquencies must be paid and all future water service must be separately metered and billed to each consumer before service is restored.
14.16.040 New and converted dwelling units, Any dwelling house, multiple-dwelling unit, building, trailer court or other like structure or premises which is hereafter constructed or converted and is occupied by more than one owner, tenant or consumer, the water service shall be separately metered and billed to each such consumer.
SECTION 2: REPEALER. All ordinances or parts thereof in conflict with the provisions of this ordinance are hereby repealed.
SECTION 3: SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional such adjudication shall not affect the validity of this ordinance as a whole or any section, provision, or party thereof not adjudged invalid or unconstitutional.
SECTION 4: WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval, and publication as provided by law.

ORDINANCE NO. 484
AN ORDINANCE AMENDING TITLE 10 OF THEWILTONMUNICIPAL CODE ENTITLED
“VEHICLES & TRAFFIC” REGARDING CERTAIN STOP SIGNS IN THE CITY OFWILTON,IOWA
Be It Enacted by the City Council of the City of Wilton, Iowa as follows:
Section 1. Purpose The purpose of this Ordinance is to add and remove reference to stop signs in the portion of Title 10 of the Wilton Municipal Code pertaining thereto.
Section 2. Amendment
A) Section 10.20.010 of the Wilton Municipal Code regarding “Stop Intersections” is amended by adding the following intersections at which vehicular traffic shall be governed by stop signs:
A) (134) East and West bound traffic onEast Summit Street
at the intersectionEast Street.
B) Section 10.20.030: Remove (9) pertaining to School Zones
Section 3. Repealer All Ordinance or parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed.
Section 4. Severability If any Section, Subsection, Provision or part of this Ordinance shall be adjudged invalid or unconstitutional such adjudication shall not affect the validity of this Ordinance as a whole or any Section, Subsection, Provision or part thereof not adjudged invalid or unconstitutional.
Section 4. Penalty Any person violating any of the provisions of this Ordinance shall, upon conviction, be subject to imprisonment not exceeding thirty days or a fine not to exceed $100.00.
Section 5. Effective Date This Ordinance shall be in effect after its final passage, approval and publication as provided by law.
