Council Meeting 8-12-2020

Regular Meeting August 12, 2020 The Council for the City of Wilton, Iowa met in regular session in the Community Room at City Hall on Wednesday August 12, 2020. Mayor Robert L Barrett called the meeting to order at 7:00 PM and then led the group in the Pledge of Allegiance. Council Members present at this meeting: Wayne Budding, Keith Stanley, Sheryl Lenker, and Ted Marolf , Absent: Steve Owens The agenda was presented for approval. It was moved by Member Lenker seconded by Member Budding that the agenda be approved as presented. The roll was called and the vote recorded as follows: Ayes Budding, Stanley, Marolf and Lenker Nays: None Motion Carried The consent agenda was presented for approval. Items included were: Minutes from 07/27/2020 meeting, sidewalk reimbursement for Tina Vyncke for $500.00, Tinted Vintage Liquor License, Swanson pay app#1 for $ 12,503.90 and Wilton Pool Allocation for $15,000. It was moved by Member Stanley seconded by Member Marolf that the consent agenda be approved as presented. The roll was called and the vote recorded as follows: Ayes: Budding, Stanley, Lenker and Marolf Nays: None Motion Carried CITIZEN APPEARANCE: Tom Taylor has requested permission to form a golf cart parade. It will be scheduled for Aug 22 and be open to anyone wishing to take part in the parade. He felt this would be nice to have one because Founder’s day parade was cancelled. The parade will follow the usual Founder’s day parade route but end at the Candy Kitchen. It was moved by Member Marolf seconded by Member Lenker that the golf cart parade be approved as presented. The roll was called and the vote recorded as follows: Ayes: Budding, Stanley, Lenker and Marolf Nays: None Motion Carried CONSULTANTS: Wilton Development Director Becky Allgood reported that the City of Wilton is really lucky to have the Muscatine County Freedom Rock. She has received several calls for people wanting to see it. The Freedom Rock will be a big draw for visitors to the City. LEGAL ITEMS: Ball presented the council with a General Fund Loan between the City of Wilton and the Wilton Development Corporation. The Development Corporation has requested financial assistance from the City in the form of a loan to cover construction period financing for workforce housing units in a total amount not to exceed $600,000. The City will receive full payment of all advances for each property upon closing of mortgage loan plus interest for each property and house. It was moved by Member Budding seconded by Member Marolf that the agreement for the loan between the City and Development Corporation be approved as presented. The roll was called and the vote recorded as follows: Ayes: Budding, Stanley, Lenker and Marolf Nays: None Motion Carried City Administrator Ball presented an Agreement between Residents of Wilton and the City of Wilton Regarding Maintenance of Private Storm Water Runoff Lateral. The record title holders of the lots where the storm water runoff lateral is located are as follows: Jeff and Edna Housemann, Barb Vitek, Thomas and Diane Taylor, Joseph Mooney and Chelsie Kammeyer, Stan and Tami Sawvell, and Keith and Holly Pearl, and the record titleholders of the properties that abut the storm water runoff lateral are as follows: Cindy Barber, Jeffrey Wilson and Diane Heymans, Michael and Susan Norton, Frank and Brenda Garren, and Billy and Joyce McCrabb. The record title holders of the property where the private storm water runoff lateral is located and the record title holders of the property that immediately abut and benefit from the private storm water runoff lateral have requested the City of Wilton repair the private storm water runoff lateral. The City of Wilton agrees to repair the private storm water runoff lateral located on 6 properties one time during the calendar year of 2020 for repairs not to exceed $1200.00, but declare that said maintenance does not indicate an ownership interest or future responsibility to maintain said storm water runoff lateral. The City of Wilton shall not be responsible for any additional repair or maintenance of after its initial repair of the private storm water runoff lateral at issue and shall be held harmless by the record title holders of the property where the storm water runoff lateral is located and for those properties which shall benefit from such storm water runoff lateral. Ball indicated that the agreement will not be put in place unless all the above listed residents sign the agreement. It was moved by Member Stanley seconded by Member Marolf that the city enters into this agreement with said residents and repairs the private storm water runoff laterals. The roll was called and the vote recorded as follows: Ayes: Budding, Stanley, Marolf and Lenker Nays: None Motion Carried A Resolution Approving an Easement Agreement for the City of Wilton was presented to the council. The Iowa Finance Authority Clean Water Program and the City of Wilton have determined a need for a drainage easement at Hy-Line North America, LLC. If the City of Wilton has the necessary funds the water way can be expanded along this property and carry through to the Fitzer property. It was moved by Member Budding seconded by Member Lenker that the city enters into this easement agreement with Hy-Line North American, LLC. The roll was called and the vote recorded as follows: Ayes: Budding, Stanley, Marolf and Lenker Nays: None Motion Carried The Mayor then declared Resolution No. 08122020C duly adopted CORRESPONDENCE: The Post Prom committee from the Wilton High School sent a thank-you note thanking the City for contributing to the Post-Prom 2020 event. MAYOR ITEMS: Mayor Barrett commented on the condition of 5th Street repair. It was noted that the road is rough and may need further repair. He also noted how the clean-up seems to be moving along nicely but is taking some time because of the extensive damage. Comments were made about how the Citizens have contributed to the clean-up. The Mayor and Council would like to thank all the citizens that helped clean up after this storm. Some problem areas have been brought to the attention of the Council. The property owners identified will be sent nuisance letters. The condition of some of the yards will be addressed and the residents will be encouraged to correct the municipal infractions. COUNCIL ITEMS: The Muscatine County Freedom Rock committee has requested a street closure for the dedication ceremony on September 6th, 2020. They have requested a street closure at the alley on Maurer Street by the City Garage, on N Railroad Street by BWP sales, not blocking the driveway and at N Railroad Street at the back entrance to the post office. It was moved by Member Stanley seconded by Member Lenker that the city allows the requested street closure for the Freedom Rock Dedication. The roll was called and the vote recorded as follows: Ayes: Budding, Stanley, Marolf and Lenker Nays: None Motion Carried A Resolution entitled “A Resolution Concerning the Fees Charged for Solid Waste by The City of Wilton, Iowa” was presented to the Council for discussion. Such resolution sets the rates of residential and commercial rates for collection of rubbish, garbage and mixed refuse. The garbage fund needs to have increased revenue due to the rate increase from the facilities that handle our waste. It was then moved by Member Marolf seconded by Member Stanley that such Resolution be adopted with the fees going into effect on September 1, 2020. The roll was called and the vote recorded as follows: Ayes: Budding, Stanley, and Marolf Nays: Lenker Motion Carried The Mayor then declared Resolution No. 08122020A duly adopted Grovespring Area Voluntary Fire Protection Association is offering $55,000.00 for the 2000 Freightliner/Alexis 4 door 2500 gallon pumper Tanker. This offer is with the provision that the water leak will be repaired before the transaction is complete. It was moved by Member Marolf seconded by Member Budding that the city accepts this bid pending the cost of the needed repair. The roll was called and the vote recorded as follows: Ayes: Budding, Stanley, Marolf and Lenker Nays: None Motion Carried BILLS The financial Statements were accepted and placed on file. It was moved by Member Lenker seconded by Member Stanley that the total disbursements of $244,349.61 be approved by the Finance Committee, be allowed and instruct the City Clerk to pay the same. The roll was called and the vote recorded as follows: Ayes: Budding, Stanley, Lenker and Marolf Nays: None Motion Carried. ADMINISTRATIVE ITEMS: A Resolution entitled “A Resolution of the City of Wilton in Support of the Approval and Adoption of the Muscatine County Multi-Jurisdiction Local Hazard Mitigation Plan was presented to the council. The City of Wilton, Muscatine County and the Bi-State Regional Commission has gathered this information and prepared this plan to make the City eligible to apply for aide and grants in the event of a storm or hazard. It was moved by Member Lenker and seconded by Member Stanley that said Resolution be adopted. The roll was called and the vote recorded as follows: Ayes: Budding, Stanley, Marolf and Lenker Nays: None Motion Carried The Mayor then declared Resolution No. 08122020 duly adopted The Police Department would like approval for purchasing some Fitness Equipment. A very fair bid was received from Treadmill Hero’s. This equipment would be housed in the unused area of the basement. The City will implement a policy for proper use and clean up of the equipment. It was moved by Member Stanley and seconded by Member Budding that the Police department be allowed to purchase said equipment.
