Regular Meeting

                The Council for the City of Wilton, Iowa met in regular session in the Council Chambers at City Hall on Monday June 13, 2022  Mayor Keith Stanley called the meeting to order at 6:00 PM and then led the group in the Pledge of Allegiance.  

Council Members present: Ted Marolf, Bill Voss, Wayne Budding, Steve Owens and Sheryl Lenker


 The agenda was presented for approval.  It was moved by Member Budding seconded by Member Marolf that the agenda be approved as presented. The vote recorded as follows: Ayes: All   Nays: None   Motion Carried


The consent agenda was presented for approval. Items included were: Minutes from 5/23/2022 meeting, donation for Muscatine County Fair ($500.00), Resolution 06132022C for Operating Transfers, and Final Payment to WDC for housing Lots.  It was moved by Member Marolf seconded by Member Lenker that the consent agenda be approved as presented. The vote recorded as follows: Ayes: All   Nays: None   Motion Carried




                Robert Chapman of 101 W 1st Street appeared before the council to discuss the city code violation he received for having over the limit of number of animals permitted in the city of Wilton by Municipal Code.  He feels that he is unfairly targeted for having too many dogs when he knows of other residents in town that have more than 4 dogs.  Police Chief Dave Clark addressed that issue with the other homeowners in town and felt that they are complying with the ordinance.  Member Owens asked if the dogs are all vaccinated, in which Mr. Chapman replied that they were.  Police Chief referenced a letter he received from a concerned citizen about the dogs behavior which included excessive barking and the aggressiveness they displayed towards other animals.  Mr. Chapman admitted and the Police Chief confirmed that occasionally one or more of the dogs will get out of their enclosure.  After some further discussion, it was moved by Member Marolf seconded by Member Voss that the ordinance should be enforced as it stands.  The vote recorded as follows: Ayes: All   Nays: None   Motion Carried




                 Wilton Economic Development Director Allgood reported that she has sent Chandler Point a list of residents that are interested in the apartments.  The City does not have anything to do with the renting of these apartments.  She has been busy with the WDC and helping with the Chamber of Commerce.  Member Voss inquired if there will be plans on building another apartment complex.  Allgood replied that there are no plans at this time but that it would not be ruled out if the interest is there.


                City Administrator Jeff Horne reported meeting with the Muscatine County Board of Supervisors about the Designation Iowa Y14 Trail project. He felt that he got a very positive response to this and will combine it with the City of Muscatine project.


The sidewalk project is moving right along. We have over 3,000 feet now completed. Member Owens wanted to know when

back filling would be done because now would be the time to start seeding. Jeff Horne informed the Council that they will be starting on that soon.

                Be It Resolved by the City Council of the City of Wilton, Iowa:

                Section 1.  The following persons and positions named shall be paid the salaries or wages indicated and the Clerk is authorized to issue warrants, less legally required or authorized deductions for the employees paychecks every two weeks and to make such contributions to IPERS and Social Security or other purposes as required by law or authorization of the City Council, all subject to audit and review by the City Council.

                RESOLUTION NO. 06132022B



WHEREAS, the City of Wilton started its EMS service in July 2021; and


WHEREAS, the Administrative needs of the service have exceeded the capacity of volunteers ; and


WHEREAS, The City of Wilton wishes to establish a position for the management of the EMS Department;


NOW, THEREFORE, BE IT RESOLVED by the City of Wilton City Council that the job description for the EMS Director is approved.


                It was moved by Member Marolf seconded by Member Lenker that the resolution be approved as presented. The vote recorded as follows: Ayes: All   Nays: None   Motion Carried          


                Police Chief Clark introduced Nick Frommelt as the new police officer hire/EMS director.  Nick is a certified police officer and is one of the EMS staff volunteers that is working hard to make the program successful.  He recently was instrumental in getting ready for a Iowa Department Public Health inspection which they passed.  Nick will be a great asset to have as the New Director which should help with filing reports, billing and payments.


                HR Green Professional Services Agreement for Wilton 5th Street from HWY The project is described as design services for the reconstruction and widening of 5th Street from US Highway 6 to Liberty Street. The existing 5th Street’s two-lane asphalt section with ditches will be replaced with a three-lane PCC urban design with curb and gutter, storm sewer and a trail along the north side of the road. Additionally, a right turn lane will be constructed for the new apartment housing development to the north of the corridor. The roadway will be widened to a three-lane cross section, with one lane in each direction and a center turn lane. The intent is for this project to be “shovel ready” for potential federal stimulus dollars. The work to be completed by the Consultant under this agreement shall include topographic survey, roadway design, trail/sidewalk design, streetscaping design, lighting design, plan preparation, easement/acquisition plats preparation, and public involvement. Bid phase services; permit applications; environmental compliance and cultural resource services, and construction phase services will be provided by amendment when funding becomes available. After some discussion it was moved by Member Budding seconded by Member Marolf that the agreement be approved as presented.                 Professional Services Agreement with MSA for Comprehensive Plan: The council approved proceeding with a new comprehensive land use plan in the budget. This would be paid over two years. The last time the plan was updated with 2007-08 and it needs work. It is the underlying legal document supporting our zoning ordinance. After some discussion it was moved by Member Marolf seconded by Member Owens that the MSA agreement be approved as presented.                 Jeff Horne presented the Council with a letter that summarizes the progress of the Vegetation Establishment project through January 10, 2022. Impact7G has acquired additional native seed for the sponsored project and is preparing for spring seeding of the

water and sediment control basins and maintenance of the wetlands. Pay Application Invoice 25889 for $450.45 was submitted by Impact 7G to HR Green on May 9. The 5% retainage for the work completed to date is $1,568.10 ($1,544.39 from previous Pay Applications + $23.71 from Invoice 25889). There have been no change orders for this contract so far. HR Green has approved the invoice. It was moved by Member Budding seconded by Member Voss that the payment application be approved as presented. THIS AGREEMENT made and entered into this 14th day of June, 2022, by and between A Notch Above Tree Service, hereinafter called the “Contractor” and the CITY OF WILTON, IOWA, a municipal corporation, hereinafter called the “Owner”.

That the Contractor and the Owner, for the consideration herein stated, do agree as follows:

ARTICLE I. SCOPE OF WORK: The contractor shall perform everything required to be performed, and shall provide and furnish all labor, materials, and all utility and transportation services required to perform and complete in a workmanlike manner, all of the work required and contemplated by this Contract for “2022 ASH TREE REMOVAL PROGRAM” in the City of Wilton, Iowa, contemplated by this Contractor, all in strict accordance with the Contract and Specifications, together with the Contractor’s Proposal to be considered and made a part of this Contract.

ARTICLE II INDEMNITY CLAUSE: Contract does hereby covenant and agree to indemnify and save harmless the Owner from all fines, suits, claims, demands and actions of any kind and nature by reason of any and all of its operations hereunder, and does hereby agree to assume all the risk in the operation of its business hereunder and shall be solely responsible and answerable for all accidents or injuries to persons or property damage.

ARTICLE III CONTRACT PRICE: The Owner shall pay to the Contractor for the performance of his Contract, subject to any additions or deductions, in the manner provided in the applicable specifications the following sum: Removal of Trees and Stump, logs removed from yards and disposed at City site, cleanup of brush and debris.

ARTICLE IV COMPLETION OF WORK: Contractor agrees to commence work once the contract has been signed and completed by October 31, 2022 and does further agree to fully complete all work according to all Specifications and Contract documents. This Contract is intended to conform in all respects to the applicable statutes of the State of Iowa, and if any part or provision of this contract conflicts therewith, then in that event said statutes shall govern.

IN WITNESS WHEREOF, the parties hereto have caused this instrument to be executed in two original counterparts, the day and year first above written.

It was moved by Member Marolf seconded by Member Lenker that “A Notch Above” be awarded the bid and be approved as presented. The vote recorded as follows: Ayes: All   Nays: None   Motion Carried          




                Member Voss asked questions about the recycling program.  He wondered if anything could be done for the residents that are physically unable to get their recycling to the Convenience Center.   The citizens that are interested in curbside recycling are welcome to call Oveson Refuse.  Oveson will pick up recycling at the curb for a fee.  




The Financial Statements were accepted and placed on file.  It was moved by Member Marolf seconded by Member Budding that the total disbursements of $645,065.21 approved by the Finance Committee, be allowed and instruct the City Clerk to pay the same.  The vote recorded as follows: Ayes: All   Nays: None   Motion Carried
